GiveBack Live is a fundraising platform operated by Platinum Rule Consulting LLC. Nonprofit organisations use it to run the auctions, raffles and giving at their events. These terms are the agreement between you and Platinum Rule Consulting LLC when you register for an event, bid, enter a raffle or make a gift through GiveBack Live.
Who you are dealing with
Two parties are involved in every event. Platinum Rule Consulting LLC provides the technology: the pages you use, the bidding, the messages and the record of what you owe. The nonprofit hosting the event runs the event itself — it sets the items and prices, decides who wins, collects the money, fulfils the prizes and issues any tax receipt.
That split matters when something goes wrong. Questions about an item, a prize, a refund or a receipt are for the nonprofit hosting your event. Questions about the platform are for us, by email at support@mygivebackhub.org or by post at 250 N Litchfield Rd Ste 261, Goodyear, AZ 85338.
Registering for an event
You must be at least 18 years old to register, bid, enter a raffle or give. You agree that the name, mobile number and email address you give us are your own and are accurate.
Your mobile number is your identity on the platform. When you return on a different phone we send a one-time code — by text if you asked for texts, otherwise to your email — to bring you back to your record. Anyone holding that code can act as you, so keep it to yourself, and tell us straight away if you think someone else has used your number.
Your bidder number, not your name, is what appears on public screens and bid histories, unless you opt in to showing a recognition name when you register.
Text messages
We text you only if you ask us to. Ticking the box at registration turns on texts from the nonprofit hosting your event; leave it unticked and we never text you at all — your sign-in code arrives by email instead, and everything else works the same. What the texts carry, if you turn them on, is your own participation, never marketing:
- the one-time code that signs you in on a new phone
- a welcome message with your bidder number
- outbid alerts, and notice that you have won an item or a raffle prize
- payment receipts, failed-payment notices, and reminders to settle at the desk
You can register, bid, enter a raffle and give without ticking that box. Message frequency varies with the event and with how actively you bid — a quiet event may send two or three messages, a competitive auction may send more. Message and data rates may apply.
Reply STOP to any message to stop receiving them, or HELP for help. You can also reach us at support@mygivebackhub.org. Stopping texts does not remove your registration or cancel anything you have bid on or agreed to pay; your sign-in code simply goes back to arriving by email. It does mean you may not learn that you have been outbid or have won until you look at your page.
Mobile carriers are not liable for delayed or undelivered messages. Not every carrier or handset supports every message.
Bidding and buying
A bid is an offer to buy at that price, and it is binding. If you hold the winning bid when an auction closes, you have agreed to buy the item at that amount.
Raffle entries are final once purchased. Winners are drawn by the nonprofit under its own rules.
Items and prizes are provided by the nonprofit and its donors as-is. Nothing on the platform is a warranty from us about an item's condition, value, authenticity or fitness for any purpose, and a stated value is the nonprofit's estimate, not an appraisal.
Raffles
Where an event offers a raffle, the nonprofit hosting it is solely responsible for whether that raffle is lawful where it is held, for any licence or registration it needs, for its official rules, and for drawing and awarding prizes. We provide the technology only and do not determine, verify or guarantee the legality of any raffle. Void where prohibited.
Donations and tax receipts
A gift you make through GiveBack Live goes to the nonprofit hosting the event, not to Platinum Rule Consulting LLC. Whether it is tax-deductible, and what portion of it is, is determined by that nonprofit and by your own circumstances. Any tax receipt or acknowledgment comes from the nonprofit. We are not a charity and do not issue tax receipts.
Payments and refunds
Card payments are handled by a third-party payment processor chosen by the nonprofit. Your card details are entered on the processor's own secure form and are sent to the processor, not to us — we never receive or store your full card number. What we keep is the amount, the payment method type, the processor's reference, and whether the payment succeeded.
Cash and cheque payments are settled with the nonprofit's volunteers at the event, and are recorded on the platform when a volunteer confirms them.
Refunds, cancellations and disputes about an amount are between you and the nonprofit hosting the event; it holds the funds and decides. We can help the nonprofit locate and correct a record, but we cannot issue a refund on its behalf.
Using the platform fairly
Do not bid without intending to pay, register under someone else's number, use the platform to interfere with an event, attempt to gain access to another attendee's record or to staff tools, scrape or bulk-collect data, or probe, overload or disrupt the service. A nonprofit's staff may block a bidder from its event, and we may suspend access to the platform where we reasonably believe it is being misused.
Availability and disclaimers
The platform is provided as-is and as-available. We do not warrant that it will be uninterrupted or error-free, that a message will always arrive, or that a bid will always be recorded — venue wifi, mobile networks and carriers are outside our control, and a live event does not wait.
To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, Platinum Rule Consulting LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunity or lost data, arising out of your use of GiveBack Live. Our total liability to you for any claim relating to the platform will not exceed the greater of the amount you paid through the platform in the twelve months before the claim, or one hundred US dollars.
Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
Changes to these terms
We may update these terms. The current version is always published at https://givebacklive.org/terms with the date it took effect. Continuing to use the platform after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The state and federal courts located in Arizona have exclusive jurisdiction over any dispute arising out of them, and you and Platinum Rule Consulting LLC each consent to that jurisdiction.
